Juridical Qualification Formulation and Judicial Ratio Decidendi in Mitigating Sentencing Disparities in Narcotics Crime

Criminal law enforcement against illicit substance abuse tests judicial consistency in strictly separating the qualifications of illicit trafficking and self-consumption. This study examines the construction of criminal law norms and the judicial ratio decidendi to mitigate sentencing disparities. A normative legal research method is employed through a doctrinal analysis of written legal materials and court jurisprudence. Findings indicate that distinguishing legal qualifications requires comprehensive proof of the offender’s subjective intent rather than relying solely on quantitative thresholds of drug weight. Inconsistencies in judicial reasoning lead to sentencing disparities that undermine legal certainty. Mitigating these disparities necessitates structured sentencing guidelines, optimization of internal judicial directives, and the application of individualization principles supported by objective medical evidence. Strengthening the unifying legal function of the Supreme Court remains crucial for establishing a proportional, transparent, and substantively just criminal justice system.
